Australian distributor assures Xpeng owners amid court battle

The importer and distributor of Xpeng vehicles in Australia has sent a letter assuring owners and prospective buyers it remains committed to the brand, and that it will continue supporting customers despite an ongoing legal dispute with the automaker.

In a letter sent to Xpeng owners and prospective customers on May 6, 2026, TrueEV chief executive officer Jason Clarke apologised for a lack of communication since the court battle became public more than two months earlier.

“Let me start by apologising for not contacting you sooner,” the TrueEV boss said.

“Over the past 16 months, changes undertaken by Xpeng have materially impacted operations, resulting in ongoing challenges and uncertainty for TrueEV. Unfortunately, we’ve had to attempt to resolve these issues in the Federal Court.

“During this period, there have been challenges affecting areas such as vehicle supply, parts availability and certain processing timelines.”

“We acknowledge that this may have caused inconvenience to some customers … [but] I can assure you … Warranties will continue to be supported; Cashback offers are being processed as we work through current backlogs; [and] customer support and after sales services are a priority,” the letter continues.

“We are doing everything we can to maintain continuity.

“TrueEV remains fully committed to supporting our customers, partners, and the Xpeng brand in Australia.”

CarExpert contacted a number of Xpeng showrooms which said they were continuing to operate as normal for sales and servicing.

Sydney-based TrueEV introduced the Xpeng brand to Australian buyers in August 2024 when it launched the G6 electric SUV, a mid-size rival to the Tesla Model Y and BYD Sealion 7.

It went on to establish a network of around 15 dealers and almost 60 service centres across Australia, with plans to add the G9 large SUV and X9 people mover to the local lineup.

However, on March 4, 2026, legal action commenced in the Federal Court of Australia between TrueEV and Xpeng itself: Guangzhou Xiaopeng Motors Trading Co Limited, Shenzhen Xiaopeng Motors Supply Chain Management Co Ltd, and Xpeng Motors Australia Pty Limited (Xpeng ANZ).

Multiple hearings have since taken place, with TrueEV ordered by the court on April 30 to pay just over $1.25 million as security for costs in the case.

It’s unclear whether the amount has been paid, with TrueEV entering administration on March 19, 2026, after what appears to have been unmet loan obligations.

The next scheduled court date for the case is October 6, 2026.

Xpeng Motors Australia Pty Limited has since established its own Australian operation, with former GWM Australia chief operating officer Hidesuke Takesue listed on LinkedIn as its chief operating officer from April 2026, after having previously been listed as a “senior executive consultant” with the company.

An April 2026 press release from the automaker said the change would usher in a “new era of trust and intelligence.”

“To ensure [our] sophisticated global technology is delivered in its purest and most efficient form, we have chosen to evolve our market presence into a direct factory-backed model,” it said.
